Three chieftains of the Peoples Democratic Party ( PDP) in Enugu State billed to be arraigned for alleged forgery have filed an ex parte motion seeking to stop their trial coming up December 9.
In a motion filed before Justice Reuben Odugu of the Enugu High Court, the PDP chieftains are asking the court to restrain the state Attorney General and the Inspector General of Police from going ahead with the criminal prosecution in the state.
The three PDP members (names withheld) who all hail from Ezzeagu L.G.A filed the motion praying to be granted ex-parte order to stop their prosecution for forgery, impersonation and perjury, a matter already slated for arraignment.
A fiat had already been granted by the Attorney General of the state to an Independent counsel for the prosecution after advice from the Federal Ministry of Justice.
Justice Odugu had on December 2014 issued a restraining order on one of the defendants from parading himself as a candidate of the PDP in the last election.
The court order was alleged to have been flouted when the defendant went to an Abuja High Court to institute a matter against the acclaimed winner of the PDP primary in contention.
It was based on suspected forged documents allegedly tendered at the Abuja High court by the defendant that a petition was written to the Nigerian Police Force Headquarters that investigated the case.
The police confirmed a criminal case of forgery, impersonation and perjury and proceeded for prosecution at the Enugu high court.
